These Terms of Service ("Terms") constitute a legal agreement between you and AllCoda LLC, a Texas limited liability company ("Company," "we," "our," or "us"), governing your use of the MyMotivation mobile application, including all related features, content, and services (collectively, the "Service").
By downloading, installing, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Service.
1. Acceptance and Modification of Terms
Binding Agreement: These Terms form a binding contract between you and AllCoda LLC. Your use of the Service constitutes acceptance of these Terms.
Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.
Entire Agreement: These Terms, together with our Privacy Policy and any subscription terms, constitute the entire agreement between you and us regarding the Service.
2. Description of Service
MyMotivation is a mobile application that provides:
- Daily motivational quotes and content
- Personal goal tracking and progress monitoring
- AI-powered personalization and insights
- Community sharing features
- Premium subscription features
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without liability to you.
3. Eligibility and Account Requirements
Age Requirement: You must be at least 13 years old to use our Service. If you are under 18, you must have your parent or guardian's permission.
Account Accuracy: You must provide accurate, current, and complete information during registration and maintain the accuracy of such information.
Account Security: You are responsible for:
- Safeguarding your password and account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use or security breach
One Account Per Person: Each user may maintain only one account. We reserve the right to suspend or terminate duplicate accounts.
4. Subscription Terms and Payments
Free and Premium Services: We offer both free and premium subscription tiers. Some features require a paid subscription.
Subscription Billing:
- Subscriptions automatically renew unless canceled before the renewal date
- Billing occurs at the beginning of each subscription period
- We do not provide refunds for partial subscription periods
Payment Processing: Payments are processed through:
- Apple App Store (for iOS users)
- Google Play Store (for Android users)
- Our third-party payment processors for web purchases
Platform-Specific Terms:
- Apple Users: Purchases through Apple are subject to Apple's terms. You can manage subscriptions in your Apple ID settings.
- Google Users: Purchases through Google are subject to Google's terms. You can manage subscriptions in your Google Play account.
Price Changes: We may change subscription prices with 30 days' notice. The new price will apply at your next renewal.
Cancellation: You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.
Refund Policy:
- App store purchases are subject to the respective store's refund policy
- We do not directly control refunds for app store purchases
- For web purchases, refunds are provided only where required by law
5. License and Restrictions
Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
Restrictions: You agree NOT to:
- Copy, modify, or distribute the Service or its content
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Access the Service through automated means (bots, scrapers, etc.)
- Interfere with or disrupt the Service or its servers
- Circumvent any security or authentication measures
- Share your account with others
- Use the Service to harm, threaten, or harass others
- Upload viruses or malicious code
- Engage in any activity that could damage our reputation
6. User Content and Conduct
Your Content: You may submit content to the Service ("User Content"). You retain ownership of your User Content but grant us the following license:
Content License: By submitting User Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the Service and our business operations.
Content Representations: You represent and warrant that:
- You own or have the rights to your User Content
- Your User Content does not infringe any third-party rights
- Your User Content complies with these Terms and all applicable laws
Prohibited Content: You may not submit content that:
- Is illegal, harmful, threatening, abusive, or harassing
- Contains hate speech or discriminatory content
- Is sexually explicit or contains nudity
- Infringes intellectual property rights
- Contains false or misleading information
- Violates another person's privacy
- Promotes dangerous or illegal activities
Content Removal: We reserve the right to remove any User Content at our sole discretion, without notice or liability.
7. Intellectual Property
Our Property: The Service and all its content (excluding User Content) are owned by AllCoda LLC or our licensors and are protected by intellectual property laws.
Trademarks: "MyMotivation" and our logos are our trademarks. You may not use them without our written permission.
Feedback: Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution to you.
8. Privacy and Data Usage
Privacy Policy: Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms.
AI and Machine Learning: We use artificial intelligence and machine learning to:
- Personalize your experience
- Provide insights and recommendations
- Improve our Service
By using the Service, you consent to such processing of your data as described in our Privacy Policy.
9. Third-Party Services and Content
Third-Party Links: The Service may contain links to third-party websites or services. We are not responsible for such third-party content or services.
Advertising: We may display advertisements in the free version of our Service. Your interactions with advertisers are solely between you and the advertiser.
App Stores: Your use of the Service is also subject to any applicable app store terms and conditions.

By using the Service, you consent to receive push notifications. You can disable notifications through your device settings, though this may limit Service functionality.

AS-IS BASIS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
NO WARRANTY: WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NO GUARANTEE: We do not guarantee that the Service will be uninterrupted, secure, or error-free.
CONTENT DISCLAIMER: Motivational content is for general informational purposes only and should not be considered professional advice.
12. Limitation of Liability
NO INDIRECT DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
LIABILITY CAP: OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
ESSENTIAL PURPOSE: THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
13. Indemnification
You agree to defend, indemnify, and hold harmless AllCoda LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your User Content
- Your use of the Service
- Your violation of any third-party rights
14. Dispute Resolution and Arbitration
Informal Resolution: Before filing any legal action, you agree to try to resolve disputes informally by contacting us at: legal@allcoda.com
Binding Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
Arbitration Location: Arbitration will be conducted in Texas, using the English language.
Individual Basis: All disputes must be brought in your individual capacity, not as part of any class action.
CLASS ACTION WAIVER: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Small Claims Exception: Either party may bring qualifying claims in small claims court.
15. Termination
By You: You may terminate your account at any time through the app settings.
By Us: We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms.
Effect of Termination: Upon termination:
- Your license to use the Service ends immediately
- You must cease all use of the Service
- We may delete your account and data
- Paid subscriptions continue until the end of the current billing period
Survival: Provisions that by their nature should survive termination will remain in effect.
16. General Provisions
Governing Law: These Terms are governed by Texas law, without regard to conflict of law principles.
Venue: Any legal action must be brought in the courts of Texas.
Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment: You may not assign these Terms. We may assign our rights to any successor or affiliate.
Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.
17. International Users
If you access the Service from outside the United States:
- You consent to the transfer and processing of your data in the United States
- You are responsible for compliance with local laws
- You acknowledge that data protection laws may differ from your jurisdiction
18. Digital Millennium Copyright Act (DMCA)
We respect intellectual property rights. To report copyright infringement, send a DMCA notice to:
